Draft — not yet reviewed
This document describes what the site and the platform actually do, in the structure the law requires, but it has not been through legal review and 6 items are still to be completed. Those are marked in place below. The page is served noindex until it is reviewed and signed off.

These terms govern the use of this website, the WattWisely charging platform, and the driver app. Using any of them means accepting them.
They are not the whole story for a paying customer. If you have signed an agreement with us, that agreement governs the commercial relationship — price, term, notice, service levels — and takes precedence over anything on this page. Nothing here reduces rights you have as a consumer under mandatory law.
1 What the service is
WattWisely is a hosted charging station management system. Operators connect OCPP-compatible chargers to the platform and use it to monitor them, control access, set prices, and take payment. Drivers use the app or an RFID card to find a charger, start a session, and pay for it.
We provide the software. We do not manufacture the chargers and we do not own them. The electricity supply behind it is likewise not ours.
2 Accounts
- The information you give us when creating an account has to be accurate, and kept accurate.
- You are responsible for what happens under your account, and for keeping your credentials to yourself. Tell us promptly if you think someone else has them.
- Accounts are not to be shared. An operator needing several people on one site should add them as users with their own logins rather than passing one password around.
- You must be old enough to enter into a contract in your jurisdiction.
3 Acceptable use
Do not:
- Use the service unlawfully, or to help anyone else do so.
- Attempt to access another operator's or another driver's data.
- Probe, scan, or test the security of the platform without our written permission, or interfere with its operation.
- Reverse engineer, decompile, or attempt to extract source code, except to the extent that mandatory law expressly permits it.
- Resell or sublicense access to the platform unless a signed agreement says you may.
- Connect hardware you know to be faulty, tampered with, or non-compliant with the applicable electrical standards.
We may suspend access where use of the service is unlawful, threatens the security or stability of the platform, or endangers people or equipment. Where the circumstances allow it, we will tell you first.
4 If you operate a site
Running chargers involves obligations that software cannot discharge for you. Where you operate a site on the platform, you are responsible for:
- The electrical installation, its inspection, and its ongoing compliance and safety.
- Any permits, grid connection agreements, landlord consents, and planning permissions the site needs.
- Whether hardware billed to drivers meets the metering and calibration rules that apply where the site is — in Germany, the requirements of the Mess- und Eichgesetz. The obligation to operate a compliant site is yours.
- The prices you set, the tax treatment of what you sell, and any consumer information you owe the drivers who use your site.
- Your own role as a data controller for the drivers who charge on your site, as described in the privacy policy.
5 Availability
We work to keep the platform available and will give notice of planned maintenance where we reasonably can. We do not promise uninterrupted service on this page: a service level, if you have one, is in your signed agreement, and putting a different number here would only create a conflict between the two.
Chargers hold their configuration and continue charging if their connection to the platform drops, and sessions that ran during an outage are reconciled when it returns.
Still to be completed
Whether any service level is offered publicly, and to which plans. The pricing page currently names a dedicated contact and SLA on Enterprise only. If a public uptime commitment is ever made, it belongs in the signed agreement first and is referenced — not invented — here.
6 Fees and payment
Pricing is quoted per network and can be requested on the pricing page. Where you have signed an agreement, the prices and terms in that agreement apply.
Payments from drivers are processed by our payment provider. Where we collect session revenue on an operator's behalf, it is paid out to the account the operator nominates, net of any amounts agreed in their contract.
Still to be completed
Invoicing, payment terms, late payment, taxes, and what happens on non-payment. These have to match the signed contract exactly. Drafted by a lawyer, not summarised from the pricing page.
7 Intellectual property
The platform, the apps, this website, and everything in them other than your own content remain ours. Using the service gives you a limited, non-exclusive, non-transferable right to use it for its intended purpose while your account is active, and nothing more.
Your data stays yours. We process it to provide the service, as described in the privacy policy, and we do not claim ownership of it. Where the platform is delivered under your own branding, your trade marks remain yours and we use them only to provide the service you asked for.
8 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and where liability is mandatory under the Product Liability Act. For ordinary negligence, we are liable only for breach of a material contractual obligation — one whose fulfilment makes proper performance of the contract possible at all and on which you may reasonably rely — and that liability is limited to the foreseeable damage typical of this kind of contract.
Still to be completed
This clause needs a lawyer to confirm and to complete: the cap, how it interacts with the signed customer agreement, and the position on data loss and on business interruption. Do not publish a monetary cap that has not been reviewed.
9 Ending it
You can close an account at any time. Where you have a signed agreement, its notice provisions apply.
Chargers connected to the platform speak open OCPP, so they can be pointed at another platform — ending an agreement does not leave you holding hardware that only works with us. On termination we will make your data available for export for a reasonable period before deleting it, subject to the retention obligations described in the privacy policy.
Still to be completed
State the export window as a real number of days, and confirm it matches what the customer agreement says.
10 Changes to these terms
We may update these terms as the service changes. Where a change materially affects you, we will give notice before it takes effect rather than relying on you to notice the date at the top of this page.
Still to be completed
The notice period and the mechanism for material changes, including what happens if a customer does not accept them. This is a clause German law scrutinises closely — silence being treated as acceptance is not safe to assume.
11 Governing law
German law applies. Where you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of the country in which you are habitually resident.
Still to be completed
Place of jurisdiction for business customers, and whether an arbitration clause is wanted. Confirm the registered seat first — the venue clause follows from it.
12 If part of this is unenforceable
If any provision of these terms is or becomes invalid, the remainder is unaffected, and the invalid provision is replaced by the statutory position.
Something here not clear?
If any of this affects a decision you are about to make, ask us rather than guessing. A question about your own data is answered as a data-protection request whichever address it arrives at.
